          RE:
Kirk v. Kirk

Dear Xxxx,

I just read Shepard's Opinion on the transfer in
Kirk.  It would be absolutely unreasonable and illogical for a father not to have a "chip on his shoulder" after being treated the way Mr. Kirk had been treated.  There is such gender bias in the appellate courts of Indiana, I want to vomit.

In divorce cases, how many times is the father described as having a temper?  If we disqualified every father who is identified as having a temper, no father would ever obtain custody or even get reasonable visitation.

I don't need to go through this Opinion and point out to you the anti-male comments.  The sarcastic comment about Kirk transferring to Rockford, Illinois, was put there as a suggestion that he really didn't want contact with his child.

Why do courts continue to allow the mother to make a false accusation of child molestation with impunity?  Even though I don't do a lot of divorce work, I have had this happen on two occasions.  In one instance, we went through a four day Class A felony criminal trial with a not guilty verdict in less than two hours.  You can imagine what that did to the relationship between the father and his daughters.

I know there is no way for your client to understand that there was no way for you to effectively win this case.  I understand what happened and just wanted to take the time to drop you a note.

Sincerely yours,

Xxxxxx Xxxxx
